Why Obama Wants a Supreme Court Fight on Health Reform in 2012 (Time.com)

The Obama administration's decision late Monday not to ask for a full court review of the August decision by two appeals court judges to strike down ObamaCare is a risky but potentially high-value play by the White House in the legal battle over health care reform.

An administration source says the decision was made largely for practical reasons. For starters, the White House didn't think it would prevail if the 11th circuit had agreed to reconsider the case with all of its judges weighing in. Of the ten judges who would rehear the case, five are GOP appointees, and one of the Democratic appointees, Frank Hull, was on the panel that ruled against the law in August. The outlook was so bad, says the administration official, that "it's likely [the request for a rehearing] wouldn't have even been granted." (See 10 players in health care reform.)

A full hearing might have slowed the case up, though it's not clear by how much. The Supreme Court can take up any one of several cases against ObamaCare in time to rule before it rises in June, regardless of whether all the cases have been heard at the appellate level.

But in the strategic sense, it appears the administration has decided that it wants the case heard at the Supreme Court before the 2012 election. Administration officials continue to say publicly and privately that they think they will win, and they show no signs of trying to slow the progress of the case. This is where a risk-reward calculation comes in.

If the Supreme Court ruled the law unconstitutional, it might motivate the Democratic base, but it would be a blow to Obama's support among independents, and would give the GOP a very effective tool for the six to nine month final push before the election. But there are reasons to think the Supreme court won't rule against the law. (See photos of President Obama signing the health care bill.)

The law's history in the appeals courts has been bizarre. In the sixth circuit, where two GOP judges and one Democrat were expected to rule against it, the measure was upheld, thanks to a devastating defense of its constitutionality by former Antonin Scalia clerk, Jeffrey Sutton.

In the 11th circuit, Clinton appointee Frank Hull turned on the bill and ruled the mandate unconstitutional. Then last Friday in the DC circuit, the conservative stalwart, Judge Laurence Silberman, told those claiming the individual mandate was unconstitutional, "I don't see anything in the Constitution that supports you."

Given all that, the administration figures it can win outright in the Supreme Court, even though it remains weighted 5-4 Republican appointees vs. Democratic ones, in what would be a huge campaign victory for Obama.

But another, perhaps more likely, scenario would produce a less compelling win. Sutton's main argument was that the attack on the law was too broad and was premature. He argued that ruling the entire law unconstitutional instead of waiting to see what specific parts of it were challenged when it was implemented would break with Supreme Court practice and be unwise. If conservatives like Scalia and Robert agree, the Supreme Court could simply leave open the question of ObamaCare's constitutionality for a later date. Even if that happens, politically speaking, Obama may be beleaguered enough to count that as a win.

Former Texas Prison Cook Wants Last Meal Continued ? CBS ...

HOUSTON (AP) ? A former Texas inmate who cooked the final meals for hundreds of condemned prisoners is offering to start doing it again at no cost to the state now that officials have ended the practice of allowing the special last requests.

Brian Price, who wrote a cookbook called ?Meals to Die For,? about his former duties and now runs a restaurant on Houston County Lake in East Texas, said Monday the move by prison officials was ?cold-hearted.? If it?s tax dollars people are worried about, he said, he?ll make a last meal for free for any condemned inmate in Texas.

?I am offering to prepare, and or pay for, all of the last meal requests from this day forward,? he said. ?Taxpayers will be out nothing.?

Officials who oversee the country?s busiest death chamber stopped the practice of giving special final meals last week after a prominent state senator complained about an extensive request from a man being executed for his role in a notorious hate-crime dragging death. The prison agency quickly said condemned prisoners will now get the same dinner that other inmates eat that day.

Department of Criminal Justice spokeswoman Michelle Lyons called Price?s proposal ?a kind offer.?

?It?s not the cost but rather the concept we?re moving away from,? she said.

The meal flap erupted after Lawrence Russell Brewer was executed for the hate crime slaying of James Byrd Jr. in Jasper more than a decade ago. Brewer, a white supremacist gang member, was convicted of chaining Byrd, 49, to the back of a pickup truck and dragging him to his death along a bumpy road in a case shocked the nation for its brutality.

For his final meal, Brewer asked for two chicken fried steaks, a triple-meat bacon cheeseburger, fried okra, a pound of barbecue, three fajitas, a meat lover?s pizza, a pint of ice cream and a slab of peanut butter fudge with crushed peanuts. Prison officials said Brewer didn?t eat any of it.

The request raised the ire of Sen. John Whitmire, who is chairman of the Texas Senate?s criminal justice committee. He called the tradition of offering a special last meal ridiculous and illogical.

Since Texas resumed carrying out executions in 1982, the state correction agency?s practice has been to fill a condemned inmate?s request as long as the items, or food similar to what was requested, were readily available from the prison kitchen supplies.

The exact request almost never was filled, Price said Monday. He noted that when one condemned inmate asked for two T-bone steaks, the prisoner got a hamburger steak instead.

Price made 220 final meals, beginning in 1991 and until his parole in 2003, while serving 14 years in the Texas Department of Criminal Justice Huntsville Unit for a pair of convictions related to the abduction of his brother-in-law and a sexual assault on an ex-wife.

He already was working as a prison cook, and volunteered to make a final meal after other cooks indicated they were squeamish about the task. The condemned inmate complimented his work and the duties stuck.

Question by Olu: Real Estate Investment Advise in Midtown Atlanta Ga.?
I had an offer to purchase a piece of property in an up and coming area of Atlanta Ga (called Midtown). The unit in question is a 1-bedroom apt. about 820 sq.ft for 4K.

This price is the pre-sale price as the original owner?s credit is not high enough, thus denied the financing. The going rate for similar units is around 0K (and above). I could rent it out and get up to 00 a month on it.

Question is even though it sounds like a good investment (both short term and long term) is there something I need to watchout for?

Midtown has been a popular area for investors and it sounds like you have a sweet deal, whcih I would jump on at the soonest. The only thing that concerns me about the area is that there is a glut of units coming up. So much construction concentrated in one area is never good for existing properties and may affect value down the road. This is not say, value will not appreciate but probably not as rapidly as in past years. So if you are a short term investor interested in flipping, then you might not do as well as you would have hoped. But if you are in it for the long haul, then holding on the property for rental income may pay out better down the road.

HuffPost Radio: Both Sides Now: Obama's "Math" Adds Up to "Happy Warrior"?

After months of Left and Right pounding him as not a leader, President Obama does his interpretation of Martin Luther nailing his 95 Theses to the door last Monday in the Rose Garden. Mary Matalin and Hilary Rosen debate 44's trend lines and fault lines. Is the President up due to his American Jobs Act and Buffett Rule? Down because of green scandals? We hear audio of him sounding like a "Happy Warrior" on the hustings. (For full show, listen below.)

*On Rose Garden Economics. On Monday the President in ringing tones explains that his approach is not "class warfare... it's math." And he issues a veto threat if the Congress sends him a cuts-only bill. Turning point?

Hilary regards it as a continuation of Obama's "thoughtful vision" to generate jobs in the short run and shrink deficits in the long run by selective tax hikes and spending cuts. Mary agrees that Obama has been pretty steady in his economic policies but that his Rose Garden talk is "not bold but political" and has failed before.

What failure, asks Hilary, since Clinton's rates allowed or encouraged a booming economy in the 90s? (Statistics alert!) And it's not class warfare to observe that after-tax income for top earners rose 480 percent over the past decade while the middle quintile grew only 20 percent. Mary rebuts by noting that "the highest .01 percent of income-earners paid six times more in taxes than the bottom 80 percent." Hilary surrebuts that they pay more because they earn much more, yet often pay at a lower rate. While there are 145 million tax returns annually, she adds, the so-called 'Buffett Rule" would apply only to the 450,000 or so who earn over a million dollars annually yet pay rates lower than average working Americans.

Mary wonders why Obama didn't start out pushing for a tax overhaul and reduced loopholes since that now enjoys bi-partisan consensus. Hilary wants reform to both increase top rates three percentage points and shrink loopholes.

*On Rose Garden Politics. Although Mary dismisses Obama's talk as just a "lackluster appeal to his base," Hilary challenges the argument that he only gave a "rousing sop to the Left." The rich have done well only in an America with good roads, bridges, schools... so it's only fair for them to pay somewhat more in taxes.

Mary again chides taxing "evil rich people" which forces the Host to ask if she thinks liberals are motivated by sheer hated and envy when they seek such higher taxes as opposed to trying to create jobs and reduce deficits. Answer: Obama's rhetoric forces people to that conclusion. Well, is he successfully doing jujitsu on the class warfare meme by reminding moderate voters that the GOP is the party of the rich and the Democrats the party of the middle class? Immediate polls show support for Obama's approach, Mary acknowledges, but that will change when there's either no follow-up or bi-partisan tax reform.

*Will Solyndra and Suskind dent the White House? Was the half billion dollar loan guarantee to the now bankrupt Solyndra solar panel company just a bad investment or a scandal? Hilary explains how this Green Jobs program began under Bush, that Solyndra's problems were its managers not the loan process and that this deal comprises only 1% of all the green deals.

Mary insists that there are other bad loans to energy firms showing the "crony capitalism" of the Obama White House. Let the market pick winners and losers based on the theory of comparative advantage. What about the subsidies to nuclear, which wouldn't exist without the Price Anderson Act covering potential catastrophic damages? They're different, she responds, because the levels of capitalization are different. Hilary defends the DOE loan program since "we need a mix of energy options so we're not dependent on China for this product and for national security reasons."

Ron Suskind's book Confidence Men makes the provocative claim that the early Obama White House was a "hostile work environment for women" because of the bullying and old-boy approaches of Summers, Emanuel, etc. No way, the women agree. Hilary notes how quotes were taken out of context to get to this conclusion and that Obama women are plentiful and powerful. Mary agrees in both respects: Suskind has previously taken "literary liberties" in his books and Obama is supportive of women, "as was W and Clinton and Poppy."

We listen to Obama say in front of a bridge between Ohio and Kentucky, "Mr. Boehner, Mr. McConnell, help us rebuild this bridge!" ("Mr. Gorbachev tear down this...") and also chide Palin at a NYC fundraiser: "All that 'hopey-changey stuff? That was real! Not something to be cynical about." Sound like a upbeat happy warrior? Mary thinks that such hot rhetoric hurts a naturally cerebral Obama while Hilary sees a President connecting to average voters and "remembering why he ran for president in the first place."

*Quick Takes. The women agree that the official end this week of Don't Ask-Don't Tell -- which led to 13,000 discharges over 17 years -- is important and overdue. And while they are both anti-death penalty, Mary contends that there was adequate evidence and eyewitnesses against Troy Davis, executed Wednesday for the murder of a police officer 22 years ago. And they half-agree on the spectacle of Gov. Perry calling Obama's Israel policy "appeasement" just before PM Netanyahu gives Obama a "badge of honor" for his UN stand on Palestinian statehood -- and just as the New York Magazine cover article is entitled, "The First Jewish President".

Is there anything more boring and predictable than those ?Is the 2-0 team for real?? articles?

You?ve read them. I?ve written them. They start with some team off to a surprising 2-0 start, often a last-place team from the previous season. They offer a cherry-picked storyline or two, voice some straw-man objections, then declare the team ?for real? (fuh-real, if you say it out loud) or a ?fraud? (fuh-rawd). Three weeks later, everyone forgets what was written, and no one cares.

What the heck does ?for real? mean, anyway? Is anyone picking the Lions to reach the Super Bowl? Of course not. But they have inserted themselves into the very early playoff picture, as have other surprise challengers like the Bills, Texans and Redskins. All of these teams have made great strides since last year, but what happens next has as much to do with each team?s schedule and division as with how much they have improved. As good as the Bills may be, it is silly to say they are ?for real? when the Patriots and Jets still block their path to the division crown, or that they are ?frauds? because a tough schedule could leave them at .500.

So this is no ?for real? story: it?s an honest look at four 2-0 teams, their strengths and weaknesses, and what how their upcoming schedules will affect their futures.

Bills
Strengths: Quarterback Ryan Fitzpatrick is a natural fit in Chan Gailey?s system. Fred Jackson (a league-leading 229 rushing yards) finally has the starting job to himself after years of playing second-fiddle to Marshawn Lynch and C.J. Spiller. The defense, which had trouble switching from a 3-4 to a 4-3 defense last year, is much less mistake prone than it was last year.

Weaknesses: On defense, improvement is relative. Despite the additions of Shawne Merriman, Nick Barnett, Kirk Morrison and rookie Marcell Dareus, the Bills have recorded just two sacks in two weeks and are allowing 5.0 yards per rush. Fitzpatrick and Jackson have enjoyed brief hot streaks in the past; it is hard to believe that they have taken a major step forward at this point in their careers.

The Future: AFC East teams face the NFC East, so the Bills must cope with the Eagles, Giants and improved Redskins and Cowboys in addition to their regular tormentors, the Jets and Patriots. If they can go .500 in those eight games, they can stay in the wild card hunt. Sunday?s Patriots game will be a bellwether. If they win or hang close, they can keep things interesting all year.

Lions
Strengths: Matthew Stafford is healthy and running a shotgun-based offense that has allowed him to spread the ball to 10 different receivers in the first two games. The pass defense has picked off four passes and is holding opponents to just 9.1 yards per reception. Calvin Johnson makes first-and-goal from the 2-yard line a passing down.

Weaknesses: Like the Bills, the Lions suffer from Chiefs fatigue: beating up on the Chiefs has been so easy in the early going that it is hard to draw conclusions from the Bills? and Lions? victories. It?s like winning a wrestling match against a mannequin. The Lions are thin at running back behind Jahvid Best and have no power-running presence, which can be a problem in the NFC North when the weather gets cold.

The Future: The Lions have two division games and a trip to Dallas in the next three weeks. If they go 2-1, they must be taken seriously as wild card contenders. The early-season sputters of the Vikings and Bears could help the Lions considerably. If the Vikings keep coughing up leads in the second half and the Bears stick with the 5-to-1 pass-run ratio, the Lions will have no trouble sliding into second place.

Texans
Strengths: New coordinator Wade Philips and acquisitions such as cornerback Jonathan Joseph have improved the defense significantly. The Rex Grossman-led passing game has not been a disaster, and the Tim Hightower-Ray Helu backfield committee looks strong. The soap opera silliness of last year is long gone.

Weaknesses: Kicker Graham Gano has already missed two short field goals, one of them blocked. Haslett has been coasting on reputation for years, and his defenses tend to fall to the bottom of the middle of the pack in most categories. Opponents have committed three times more penalties than the Redskins (18 to 6), which may be a sign of clean, smart football but more likely indicates that some random factors have not yet evened themselves out.

The Future: The Redskins have all the makings of a team that tails off by midseason, but the Giants? injury-a-day schedule, the Cowboys? ramshackle offensive line and the Eagles? sloppiness could create opportunities in the NFC East for a team that wins with ball control and fundamentals. Crime witness ID method can affect error rate: study (Reuters)

DES MOINES, Iowa (Reuters) ? Showing photographs of suspected criminals to witnesses in sequence, rather than all at once, can produce fewer mistakes in identifications, according to new research.

Gary Wells, a psychology professor at Iowa State University, said presenting photos one at a time produced a lower error rate than when witnesses were shown a simultaneous array of photos.

"We believe these results go a long way toward instilling greater confidence in the sequential procedure as something that improves the reliability of eyewitness identification evidence," Wells, the lead researcher, said in a conference call with journalists.

Witnesses identified a "known innocent filler" photo 18 percent of the time under the simultaneous procedure compared to 12 percent under the sequential procedure, according to the study issued by the American Judicature Society, which acts as a clearing house for information about judicial ethics and discipline.

Wells said that when witnesses were asked to look at suspects simultaneously, they tended to compare the lineup members and decide who looked most like the perpetrator.

Sequential line-up is thought to prevent the side-by-side comparison process and instead forces witnesses to use a more absolute comparison of each photo to their memory, rather than compare lineup members to each other, Wells explained.

The national study, conducted between 2008 and 2011, involved police departments in Texas, Arizona, California and North Carolina.

Wells said mistaken witness identification remained a significant problem.

"In DNA exoneration cases, for instance, 75 percent of those who were exonerated with forensic DNA tests after being convicted by juries are cases involving mistaken eyewitness identification," Wells said.

He hopes the research will encourage more law enforcement agencies to switch from simultaneous to sequential lineups. The full study is posted online at www.ajs.org.

Qaddafi loyalists hold tight to strongholds of Bani Walid and Sirte

Fighters loyal to former leader Muammar Qaddafi continue to repel advances on the key strongholds of Bani Walid and Sirte, raising questions as to just how long it will take to end the war in Libya.

New fighting has erupted near Bani Walid, one of the last holdouts of the regime loyalists in Libya, as the forces loyal to former leader Muammar Qaddafi continued to repel the revolutionary fighters.

The fighters who support the National Transitional Council (NTC) have been trying for weeks to take Bani Walid, south of Tripoli, and the coastal city of Sirte to bring the war to a close. But what they predicted would be an easy fight has instead stymied them as the heavily-armed Qaddafi loyalists appear to be fighting ferociously to the end.

The Associated Press reports that Qaddafi?s forces shelled revolutionaries at the north gate of Bani Walid Sunday. They also tried to ambush the fighters, who are stretched thin and in low spirits after weeks of unsuccessful fighting, according to the AP. The revolutionaries sent reinforcements from Tajoura to try to turn the tide in the key city, where Qaddafi?s forces hold the strategic high ground. A BBC map shows the valley dividing the town, terrain that has made the attack difficult for revolutionary forces.

The revolutionaries were also preparing Sunday to advance again on Sirte, Qaddafi?s hometown and another regime holdout, after three days of heavy fighting there, reports Reuters. If Sirte falls, the transitional government woud control Libya?s entire coast. Sirte now divides their territory between Tripoli in the west and their former defacto capital of Benghazi in the east.

Fierce resistance in Sirte

Agence France-Presse reports that the revolutionary forces retreated Saturday after pushing into the city and encountering fierce resistance.

Qaddafi?s forces pounded them with rockets, heavy artillery, and sniper fire, killing at least 24 of the fighters and wounding 40. The BBC reports that the NTC?s military spokesman said the revolutionaries had taken the airport and a major air base. But AFP reports that the fighters on the ground acknowledge a tougher reality.

"We don?t even have five percent of Sirte because we just go in and out," fighter Abdul Rauf al-Mansuri told AFP. He said the commanders? statements were incorrect, and that the fighters lost their advantage by pulling out at night.

Qaddafi urges loyalists to fight on

While the NTC forces struggled to oust Qaddafi?s loyalists, a pro-Qaddafi radio station in Sirte aired a message purportedly from the former leader himself, urging his people to fight on.

"You must resist fiercely. You must kick them out of Sirte," the voice said, according to AP. "If they get inside Sirte, they are going to rape the women."

Loyalists: We can fight for months

Qaddafi's spokesman, Moussa Ibrahim, who is thought to be in Bani Walid, spoke Friday with a Syrian pro-Qaddafi television channel. "We have the ability to continue this resistance for months," he said.

But the transitional government pressed ahead with the duties of governing a new Libya, though it is not yet fully under their control.

The AP reported that the NTC planned a press conference Sunday to announce the members of a new cabinet. NTC leaders had previously said they would not name a new cabinet until the fighting was over and they had declared Libya fully liberated.

August Thalheimer identifies two main sources of religious conceptions: (1) Relation of the individual to nature: human dependence upon nature and their desire to mater the forces of nature they cannot master in material reality. (2) Relation of the individual to society: religious conceptions and fantasies also arise from the relations of individuals to the totality of social relations primarily determined by the mode of production, or the social way in which individuals produce their material livelihood.

How many religions are there in our world, each claiming a monopoly on truth? Religion can be argued as one the oldest world views containing fundamental conceptions from which all others emerged. Thus, scholars and academics agree that religion as a world view has developed alongside the development of society: ?In most?developed?forms of religion there are not many spirits, gods, or demons, but only one god? ? Thalheimer.

The analysis of the development of religion cannot be isolated from the analysis of how human beings organize their society: there is an ?extremely close relation in ancient times between the development of ideas concerning gods and the development of social forms, social organizations.? Thalheimer, for instance, identifies the different stages of development from small feudal states to a centralized monarchy in China. These, according to the author, are marked by the simultaneous change in organization of religious hierarchy from spirits and ancestors to the eventual recognition of centralized gods.

Thus, religion should be contextualized within its own history. Religion as any other narrative, is and will always be a historical product, and as such its origin can be traced back to the individual.

In?A Contribution to the Critique of Hegel?s Philosophy of Right, Marx argues that any given criticism of philosophy ultimately begins with the criticism of religion.

Marx states;

?The religious world is but the reflex of the real world. And for a society based upon the production of commodities, in which the producers in general enter into social relations with one another by treating their products as commodities and values, whereby they reduce their individual private labour to the standard of homogeneous human labour ? for such a society, Christianity with its?cultus?of abstract man, more especially in its bourgeois developments, Protestantism, Deism, &c., is the most fitting form of religion. In the ancient Asiatic and other ancient modes of production, we find that the conversion of products into commodities, and therefore the conversion of men into producers of commodities, holds a subordinate place, which, however, increases in importance as the primitive communities approach nearer and nearer to their dissolution. Trading nations, properly so called, exist in the ancient world only in its interstices, like the gods of Epicurus in the Intermundia, or like Jews in the pores of Polish society. Those ancient social organisms of production are, as compared with bourgeois society, extremely simple and transparent. But they are founded either on the immature development of man individually, who has not yet severed the umbilical cord that unites him with his fellowmen in a primitive tribal community, or upon direct relations of subjection. They can arise and exist only when the development of the productive power of labour has not risen beyond a low stage, and when, therefore, the social relations within the sphere of material life, between man and man, and between man and Nature, are correspondingly narrow. This narrowness is reflected in the ancient worship of Nature, and in the other elements of the popular religions. The religious reflex of the real world can, in any case, only then finally vanish, when the practical relations of every-day life offer to man none but perfectly intelligible and reasonable relations with regard to his fellowmen and to Nature.?

Marx and Engles also proposed that originally, both Christianity and Islam were revolutionary movements of the poor: 2000 years ago the early Christians organized a mass movement of the poorest and most marginalized sections of society,

?The history of early Christianity has notable points of resemblance with the modern working class movement?Both are persecuted and baited, their adherents are despised and made the object of exclusive laws, the former as enemies of the human race, the latter as enemies of the state, enemies of religion, the family, social order. And in spite of all persecution, nay, even spurred on by it, they forge victoriously ahead.?

According to these authors, thus, the world of religion is a mystified world, a distorted impression of reality. However, like all ideas as produced by humans, these beliefs have their origin in the material world.

History of human and social development has proven the historical nature of religions.

Religion is an idea, product of the human imagination. It is based not on facts nor evidence of any sort. Religion is rooted in blind belief, faith, for it comes to be without prior experience. In the history of human kind, we have had societies that believed the world was flat or that the weather was manipulated by divine forces. Knowledge and science have proven otherwise.

From Religion to Politics

Marx argued that human beings created god and attributed to this creation all that was not possible to humankind. Humans then, allowed the creation of their mind to take moral control over their lives. Human beings bowed to their own creation. This, Marx refers to as fetishism.

The same fetishism can be examined in today?s politics. The very distinction between political right, centre, and left can be seen as ideas created by human societies seem to have acquired lives of their own. Conservatism, Liberalism, Labour, all have developed within the specific socio-politico-economic historical contexts unique to each political ideology.

Today, the right, center, and left have seem to have lost the historical contexts from which they emerged. Politicians today are hanging on to old ideas that are no longer relevant, no longer reflective our current world. We are allowing the creations of our ancestors determine our society, but we all understand that our present global society has surpassed the needs our forefathers have faced in their time. So why limit our choices to the same choices of our forefathers?

We need to move beyond ?old fetishized ideas and begin creating new ideas that reflect the complex nature of our society within the context of globalization. In order to do so, we need to forget labels and traditions and honestly examine the real material conditions of our society.

There does not exist one uniform, universally accepted and shared world view. There are numerous competing world views, some of which can stand opposite to each other and be mutually exclusive of each others? methods. This also applies to the world views of religion.
