SHANGHAI (AP) ? Apple Inc. is facing yet another challenge to its use of the iPad trademark in China ? this time in a court in California.

Proview Electronics Co., a unit of Proview International Holdings, which claims it owns the iPad name, filed a lawsuit against Apple's use of the trademark in mainland China at the Santa Clara Superior Court on Feb. 17, Proview spokeswoman Alice Wang said Friday.

An attempt by Proview to win an injunction to stop Apple from selling iPads in Shanghai was foiled this week when a court there rejected the case pending the resolution of a similar lawsuit in a higher court in China.

Apple had no immediate direct comment on the California lawsuit.

The companies are feuding over whether Proview sold the mainland Chinese rights to the iPad trademark to Apple in a 2009 deal.

Proview claims the sale of the iPad China trademark to a company representing Apple by its Taiwan affiliate in 2009 was invalid. Proview has not challenged the sale of other worldwide rights to the iPad trademark to Apple in the 35,000 British pound ($55,000) deal.

Apple contends that Proview included the mainland Chinese trademark in the sale and says it violated that contract by failing to transfer the trademark rights to Apple.

Proview's lawyers have indicated their company is open to settling its claim to the trademark. In the meantime, the two sides have engaged in legal skirmishes in Hong Kong and in southern China's Guangdong province, where Proview's main office is based.

There, lower courts have sided with Proview in two cases. The Guangdong High Court is due to hear Apple's appeal of the first decision on Feb. 29.

Proview International Holdings was once one of the world's leading makers of computer monitors, with sales in 50 countries and more than 7,000 employees in factories in Taiwan and China.

But the company's main focus on manufacturing cathode-ray tube displays ? the boxy monitors that have since been replaced by LCD screens ? appears to have hurt its performance.

The company's website now says it makes LCD displays, LCD televisions and LED lights. But Proview is deep in debt and faces its shares being removed from the Hong Kong Stock Exchange.

The company developed what it said was an "iFamily" range of products, including iTV, iWeb and iPAD. It launched its iPAD in 2000, but unlike Apple's 2010 tablet computer, Proview's earlier version failed to hit the market sweet spot that might have made it a hit.

Proview has sought to have commercial authorities in many Chinese cities stop sales of Apple's iPad. In suspending the case being heard in Shanghai, Pudong District Court rejected a demand for an injunction to stop iPad sales in Shanghai, where Apple has three big stores.

'Immortal' Tasmanian devil brings vaccine hope

A bizarre facial cancer threatening to wipe out the Tasmanian devil probably evolved from a single female about 16 years ago, new scans of the cancer reveal. The scans are also helping to identify gene mutations found in the cancer but not healthy tissue, which might provide targets for a vaccine to rescue the endangered species.

Devil facial tumour disease is unusual in that the cancer cells themselves act as infectious agents. The cells spread between animals through biting during fights or mating. A vaccine could prime uninfected animals against the cancer if they are subsequently bitten.

"Now we know which genes are mutated, we can begin assessing which ones might be good antigens for a vaccine," says Elizabeth Murchison of the Wellcome Trust Sanger Institute in Hinxton, UK, who led the team.

The immortal devil

After analysing DNA from 104 tumours in 69 devils, Murchison found that all of them trace back to a single female ? dubbed the "immortal devil". This animal must have been the first to develop the cancer, around 16 years ago.

She passed it on by biting other devils, and the cancer then spread through the entire population, which has seen declines of 80 per cent in affected areas.

"It's one cancer, in one devil, and has now spread through the population, like it has metastasised," says Murchison. "That devil lived on the east coast of Tasmania, and although she's dead, her cancer lives on in thousands of devils in Tasmania today, which is why I call her the immortal devil."

Evolution of a cancer

As well as revealing possible leads for vaccines, the study revealed how the original cancer has evolved. In the Forestier peninsula in the south-east of Tasmania, for example, there's evidence that one variety of the cancer disappeared and another became dominant in its place.

Tracing how the cancer is evolving might help predict how it will spread when it reaches unaffected areas, says Murchison.

Murchison and her colleagues also found evidence of mutations in immunity genes within the cancer, which could help explain why the immune systems of newly infected animals don't recognise tumours as "foreign" and kill them off.

Other researchers have suggested that extensive inbreeding might explain how the cancers evade destruction, because they are mistaken for part of the animal's normal tissue. However, Murchison said that a study by researchers at the University of Tasmania appeared to rule out the inbreeding hypothesis by showing that skin grafts between devils were rapidly attacked and eliminated.

Cancer-causing genes

"Having the genome should also allow us to identify cancer-causing genes, and hopefully find drugs that may help to control the disease," says Katherine Belov, an authority on Tasmanian devils at the University of Sydney, who was not involved in the study.

"There is some early evidence that the disease is behaving differently in devils in north-west Tasmanian populations," says Belov. "The disease there is affecting fewer devils and taking longer to kill them off, and at this stage we don't know whether that's because the devils there are more resistant, or the tumour strains are different, or both," she says. "Genomics will help us to solve this."

Murchison says that although the research is focused on the devils, the knowledge gained may be valuable if a similar disease ever emerges in humans. The only other known cancer infectious in this way is a venereal disease in dogs.

Starve a virus, feed a cure?

ScienceDaily (Feb. 12, 2012) ? A protein that protects some of our immune cells from the most common and virulent form of HIV works by starving the virus of the molecular building blocks that it needs to replicate, according to research published online in Nature Immunology.

The finding comes from an international team of researchers including scientists from the University of Rochester Medical Center, NYU Langone Medical Center, several institutions in France -- and a graduate student who who is a political refugee from Africa and is now at work in a Rochester laboratory, intent on helping his people who have been devastated by the HIV epidemic.

While researchers hope the work will one day lead to a way to make anti-HIV drugs more effective by increasing their potency against the virus, they're also excited about its implications for our knowledge of other pathogens, such as herpes viruses, which use the same machinery within our cells that HIV does to replicate.

"The findings may explain why certain anti-HIV drugs used today are more effective under some circumstances and not others," said Baek Kim, Ph.D., professor of Microbiology and Immunology at the University of Rochester Medical Center and one of three corresponding authors of the paper. "It also provides new insights on how many other viruses that afflict people operate in the body."

The work centers on a protein known as SAMHD1, which is found in white blood cells known as macrophages and related cells known as dendritic cells. Last year scientists discovered that the molecule makes it difficult for HIV-1 to infect macrophages -- cells that specialize in gobbling up and destroying invaders like viruses.

Now researchers have discovered that the molecule cuts off the supply line of the raw material that HIV needs to create DNA and replicate. That raw material, dNTP, comprises the building blocks of DNA, and without it, HIV can't recreate its DNA in our cells.

The team found that SAMHD1 destroys most of these building blocks, making it nearly impossible for HIV-1 to replicate itself where SAMHD1 resides -- the macrophages. Instead, HIV-1 uses the macrophage as a safe haven, surviving in patients for years as it dodges the immune system as well as the drugs designed to kill it. It's thanks largely to its ability to hide out in the body that HIV is able to survive for decades and ultimately win out against the body's relentless immune assault.

The team also discovered how a protein in the other common type of HIV -- HIV-2, which is found mainly in Africa -- knocks out SAMHD1. They found that the protein Vpx destroys SAMHD1, clearing the way for HIV-2 to infect macrophages. While scientists have known that HIV-2 needs Vpx to infect macrophages, they hadn't known precisely why.

Interestingly, while one might think that a virus that is able to replicate itself in crucial cells like macrophages might be more dangerous than one that cannot, that's not the case with HIV. HIV-2 is actually less virulent than HIV-1.

"We don't know precisely how SAMHD1 and Vpx affect the virulence of HIV-1 and HIV-2, but it's something we're actively exploring," said Kim. "In this case, the ability of HIV-2 to replicate more quickly in macrophages does not help it become more virulent."

One possibility is that, like a starving man who becomes more and more desperate for food, the virus -- when faced with a shortage of raw materials -- puts its mutation gear into overdrive, creating more mutations in an effort to circumvent the pathway blocked by SAMHD1. Such constant mutations are one feature of HIV that makes it so challenging to treat patients.

"It makes sense that a mechanism like this is active in macrophages," said Kim. "Macrophages literally eat up dangerous organisms, and you don't want those organisms to have available the cellular machinery needed to replicate. And macrophages themselves don't need it, because they don't replicate. So macrophages have SAMHD1 to get rid of the raw material those organisms need to copy themselves. It's a great host defense.

"The work suggests new ways to target virus replication in macrophages, a critically important cell population that serves as a key reservoir of virus infection and a contributor to HIV-induced disease," added Kim.

At Rochester, Kim was joined in the research by graduate student Waaqo Daddacha, one of two first authors of the paper. A native of the Oromia region of Ethiopia, Daddacha came as a political refugee to the United States. He started out as a computer programmer, then decided to pursue HIV research as a way to help his homeland, where the rate of HIV is one of the highest in the world. As an undergraduate in Minnesota, he visited several laboratories around the nation that focus on HIV, eventually settling on the Kim lab, which he joined four years ago.

"Back home, many people are infected with HIV, and many people are dying because of it. I wanted to contribute to help solve the problem, and that's why I decided to pursue HIV research," said Daddacha, who still has family in Oromia. In Kim's lab he is focusing on understanding drug resistance among HIV patients and on finding ways to limit resistance to make the drugs more effective in patients.

Like Daddacha, Hichem Lahouassa of the National Health and Medical Research Institute is also co-first author of the paper. The other corresponding authors, in addition to Kim, are Nathaniel Landau, Ph.D., of NYU Langone Medical Center, and Florence Margottin-Goguet, Ph.D., of the National Health and Medical Research Institute in France.

The research was supported by the National Institutes of Health, the American Foundation for AIDS Research, the European Research Council, and several organizations in France.

Judge Orders New Jersey To Pay Legal Fees For Stanley Fischer ...

NEWARK, N.J. (AP) ? New Jersey must pay nearly $1.3 million in legal fees to the attorneys who represented a former state official who won a whistleblower lawsuit.

Stanley Fischer worked in the Division of Consumer Affairs, serving as executive director of its consumer protection office, before being fired in 2007. He then sued, claiming he was let go for confronting a politically connected subordinate about workplace infractions.

A state judge awarded Fischer $260,000 in damages last year and said he should be rehired. And The Star-Ledger of Newark reports the same judge ruled last week that Fischer?s attorneys should get $1.29 million for their four years of work.

Leland Moore, an Attorney General?s Office spokesman, told the newspaper that the state has not yet decided whether to appeal the legal fees decision.

Greece, Bulgaria battle flooding; 8 dead (AP)

SOFIA, Bulgaria ? Swollen rivers in Bulgaria and Greece burst their banks Tuesday, leaving dozens of homes underwater, as Bulgarian officials declared a day of mourning for eight people confirmed killed after a dam collapse nearly washed away their village.

Bulgaria's civil defense agency warned that two other, bigger dams were also on the brink of spilling over and residents were urged to prepare for an evacuation. Authorities have started a controlled release of water from the dams to prevent overflow.

Europeans across the continent have been battling more than a week of extreme weather, with thousands still trapped by snow in remote, mountain villages in the Balkans; hundreds ? most of them homeless ? dead after temperatures hit as low as minus 33 Fahrenheit (minus 36 Celsius); and authorities now facing the prospect of flooding caused by melting snow.

A day after the dam burst, the Bulgarian government declared a day of mourning, and streets in the village of Bisser were covered with sticky mud as people returned to their water-logged homes.

At least a dozen houses had collapsed, uprooted trees blocked roads and smashed cars sat abandoned along deserted streets. Veterinary officials were collecting the bodies of dead animals from streets still covered in snow.

Bisser Mayor Zlatka Valkova said she received a phone call about the dam and tried to get out of her office in time to alert people of the eight-foot-high (2.5-meter) torrent.

"I rushed out on the street, but then I saw the wave," she said. "It was terrible, it came with such speed that I couldn't do anything."

The village's 800 residents have been provided with food, water and medicine while the recovery operations continue. District Governor Irena Uzunova said eight people have been confirmed dead, and the whereabouts of an elderly couple remain unknown.

Bulgarian President Rosen Plevneliev and the EU commissioner for humanitarian aid, Kristalina Georgieva arrived Tuesday to assess the extent of the damage.

"The next two weeks will be very difficult and the melting snow could make the situation very complex," Georgieva told reporters in Bisser.

Georgieva voiced sympathy over the loss of lives and of property of people "who had not been wealthy even before the disaster."

Further south, the heavy rain caused the Maritsa River to overflow its banks, leaving dozens of homes under water in the city of Svilengrad near the Greek border. Rescue crews helped transport nearly 100 residents to temporary shelters.

In Greece, rescuers had to help five elderly people escape from their flooded homes after the river Evros burst its banks near the country's northeastern border with Bulgaria. Several elderly residents were also evacuated overnight from another three villages in the area.

Greek civil protection authorities said a 40-year-old woman was drowned by a flash flood on the eastern Aegean Sea island of Symi late Monday, but no major damage was reported on the island. Heavy snowfall was reported across northern Greece, hampering road traffic and causing some power cuts in remote areas.

The Geneva-based World Meteorological Organization said Tuesday that an incursion of cold polar air from northern Russia brought extremely low temperatures over large parts of Europe.

The cold air was fed with strong moisture from the central Mediterranean Sea, causing heavy snowfall over parts of southeastern Europe.

Snow also caused headaches further north. Serbian emergency officials said the army will use explosives to break up ice on the Danube and Ibar rivers to try to prevent the possibility of flooding.

A 30-year-old woman died when large pieces of ice and snow collapsed on her in a suburb of the capital, Belgrade.

In Poland, meanwhile, the big freeze killed another six people in the last 24 hours, the Interior Ministry said in a statement. Ministry spokeswoman Malgorzata Wozniak said Tuesday that three other people died of asphyxiation with carbon monoxide from heaters they were using in their homes.

Heavy snowfalls trapped dozens of cars on motorways in south Ukraine Tuesday and emergency officials deployed a helicopter to rescue the crew of a cargo ship stranded in icy waters in the Sea of Azov.

Ukraine, the hardest-hit country, has recorded 135 deaths from the cold, along with more than 2150 people hospitalized with hypothermia and frostbite.

Lithuanian officials said 23 people have died so far this year due to subfreezing temperatures in the tiny Baltic republic of 3 million.

Montenegro's capital, Podgorica, was hit by strong winds that blew off roofs from houses, pulled out trees and traffic signs, turned over garbage containers and left parts of the city without electricity.

In the Croatian town of Split, on the Adriatic coast, authorities said the local hospital is overcrowded with people who sought help for injuries sustained in falls because of ice and snow. Split is unused to snow and usually has mild winters.

Italy remained in the grip of a bitter cold spell, with reports of people freezing to death. Low temperatures have even caused parts of the Grand Canal in the lagoon city of Venice to freeze over, while the south of Italy, which usually enjoys a mild climate, has seen snow that has caused power outages to thousands of people.

In Romania, snow and high winds cut off 127 communities and blocked 237 county roads, and some 1,100 people were stranded overnight in two trains.

They included nine soccer players from Otelul Galati, the Romanian champions, who were headed to Bucharest where they were due to fly to Spain for training. Local government official Dumitru Popa said the army would be sent in to move the athletes' train, which had been blocked for 29 hours and was carrying around 500 people.

Ambulances were blocked by snow and unable to reach 32 snowed-in residents, including a woman in labor in need of help, according to health officials. An electricity company said 60,000 people have suffered power outages.
